Question : Violation of WTO Treaties by US

(a) whether India proposes to file 16 cases against the US for violating World
Trade Organisation (WTO) treaties in renewable energy sector;
(b) if so, the details thereof;
(c) whether India has appealed before the WTO appellate body on the findings
and recommendations of the dispute settlement panel; and
(d) if so, the details thereof?

MINISTER OF STATE FOR POWER, COAL , NEW & RENEWABLE ENERGY & MINES (SHRI PIYUSH GOYAL)

(a) and (b): Government of India (GOI) believes that certain renewable energy programs of the United States at their sub-federal level are inconsistent with WTO provisions, in particular, the obligation under General Agreement on Tariffs and Trade (GATT), 1994, Agreement on Subsidies and Countervailing Measures (ASCM), and/or the Trade Related Investment Measures (TRIMs) Agreement of WTO.
(c): And (d): Yes, Madam. As allowed under the Dispute Settlement Mechanism of WTO, GOI has filed an appeal before the WTO Appellate Body, expressing its concern on the Panel findings and recommendations. The decision of the Appellate Body is awaited.
