Question : Partnership with GMR

((a) whether the Government has partnership of 74-26 with Delhi Airport GMR consortium in which GMR consortium has share of 74% and the Government has share of 26%;

(b) if so, whether the Government is getting its due share from the income being earned from the new airport;

(c) if so, the details thereof;

d) whether the Government is not aware of the joint venture agreements entered into by GMR controlled DIAL for a number of services separately; and

(e) if so, the steps taken by the Government against GMR and if not, the reasons therefor?

(a) Airports Authority of India (AAI) signed the Operation, Management and Development Agreement (OMDA) with Delhi International Airport Limited (DIAL) on 04.04.2006. The current shareholding pattern of DIAL is as follows: AAI 26%, GMR Airports Limited 64% and Fraport AG Frankfurt Airport Services Worldwide 10%.;

(b) & (c) As per provisions of OMDA, DIAL shall pay an annual fee @ 45.99% of Projected revenue for each year to AAI. The annual fee is payable in twelve (12) monthly instalments, payable on the 1st day of each calendar month. The monthly annual fee is being paid by DIAL on regular basis. During the period from 2006-07 to 2018-19, DIAL has paid Rs.16,700.11 Crore as annual fee to AAI.;

(d) & (e) As per provisions of OMDA, DIAL has the exclusive right to contract and/or sub-contract with third parties to undertake functions on its behalf, and sub-lease and/or license the demised premises. Further, as envisaged in OMDA, DIAL shall inform AAI of the counter-party or parties to every contract, sub-lessee or licensee, as the case may be, and their shareholding pattern.
