Question : ALLOTMENT OF RETAIL OUTLETS TO LOI HOLDERS



(a): whether IBP vide its letter No.L-21011/1/63/06-IOC dated March 20, 2007, has given its NOC for the commissioning of retail outlets of pending of LOI holders prior to issues of MOP`s letter No.P-19011/1/04-IOC dated December 27, 2004;

(b): whether the MOP vide its above letter dated 27.12.2004 had also instructed the OMC`s to with held the results of interviews conducted by selection committee of concerned oil company during the interim period between 01.04.2002 to 30.8.2004 before the issue of common guidelines of the subject;

(c): if so, whether the direction of letter dated 20.3.2007 are also applicable on such cases; and

(d): if not, the time by which the matter of declaration of withheld result by IBP and BPC would be finally decoded?

(a): This Ministry, vide its letter No.L-21011/1763/2006-IOC dated 20.3.2007, has conveyed its no objection to the proposal of IBP Co. Limited (IBP) for commissioning of 114 retail outlet dealerships for which Letters of Intent (LOIs) were issued prior to this Ministry`s letter No.P-19011/1/2004-IOC, dated 27.12.2004.

(b)to (d): This Ministry, vide letter dated 27.12.2004, had advised Public Sector Oil Marketing Companies (OMCs) to temporarily suspend allotment of dealerships under `Land Owners` category. Subsequently, vide letter dated 17.2.2005, this Ministry clarified that the temporary suspension in the allotment will be applicable only in respect of those cases where allotments were being made without recourse to open advertisements. IBP has reported that in respect of 13 locations for which interviews were conducted between November, 2002 to February, 2003, LOIs were not issued for various reasons and these cases are not included in the 114 cases as referred in (a) above and thus, directions given in letter dated 20.3.2007 are not applicable in these 13 cases. Bharat Petroleum Corporation Limited (BPCL) has reported that the Corporation does not have any such case where results were withheld due to Ministry`s letter dated 27.12.04.
