Question : INVESTIGATION BY CBI



(a) whether the Delhi High Court has commented adversely upon the C.B.I. and its capacity as an investigation agency for the delay in completing the HDW Bribe case as appearing in the Dainik Jagran on March 8, 2000.

(b) if so, the reasons for the delay in the finalisation of the investigation in the HDW case and the time by which the investigation is likely to be completed; and

(c) the steps the Government propose to take to remove the burden of investigation not strictly falling under the charter of duties of CBI?

STATEMENT REFERRED TO IN THE REPLY TO PARTS (A),(B) and (C) OF LOK SABHA STARRED QUESTION No. 379 FOR ANSWER ON 19.04.2000.
(a) The Delhi High Court while hearing Writ Petition Civil No. 2141/97 ( filed for expediting investigation in the HDW case) on 7.3.2000 perused the status report on the investigation submitted by the Central Bureau of Investigation. Subsequently on the hearing held on 27.3.2000 the Court directed the CBI to pursue the matter with German and Swiss authorities for the execution of Letters Rogatory.

(b) Investigation within India has been completed. However a large part of investigation was to be carried out in Switzerland and Germany which depends on the execution of the Letters Rogatory issued to the concerned authorities. Though matter is being persued with them, no time limit for completion of the investigation , therefore, can be specified.

(c) Cases having inter-state and international ramifications and other categories of cases specified in the CBI Crime Manual are generally taken up by the CBI for investigation. The powers and jurisdiction of the CBI are extended by the Central Government to the area of a State, for investigation of an offence in that State, under section 5 of the Delhi Special Police Establishment Act,1946, after obtaining consent of the concerned State Government under section 6 of the Act. The Supreme Court and the various High Courts also entrust cases for investigation to the CBI.
