Question : Surrogate Pregnancies

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether there is any law governing surrogacy in India or any legal procedure 209 for such activity, if not, how Government plans to regulate and monitor this, keeping in view the poverty and illiteracy, extortion and various similar factors to regulate misuse of this technology;

(b) whether the Government plans to amend the provisions of the Surrogacy Bill 2016, if so, the details thereof; and

(c) whether the Government has received many representations against the bill, if so, the details thereof?

(a): At present, there is no law governing surrogacy in India or any legal procedure for such activity.
The draft Surrogacy (Regulation) Bill, 2016 has been approved by the Cabinet on 24th August, 2016.

(b) & (c): The Surrogacy (Regulation) Bill, 2016 is likely to be introduced in the Parliament, to be approved as an Act.
