Question : VIOLATION OF MINING RULES



(a) whether the Government has prescribed any rules and regulations under which mining permission is granted on sub-lease;

(b) if so, the details thereof;

(c) the names of mining companies violating the rules and regulations prescribed by the Government;

(d) the nature of such violation made by them and the reasons therefor during each of the last three years and the current year company-wise and State-wise; and

(e) the corrective measures taken by the Government in this regard?

(a) and (b): In terms of Rule 37 of Mineral Concession Rule, (MCR) 1960, a lessee can assign, sublet, mortgage or transfer his mining lease with the previous consent in writing from the State Government concerned and in case of minerals specified in Part ‘A’ and ‘B’ of the First schedule, with the previous approval of Central Government.

(c) to (e): Data on details of companies violating the Rule 37 of MCR are not centrally maintained.
