Question : SETTING UP OF FACTORIES IN RESIDENTIAL AREAS



(a) whether factories and industries are being set up at a large scale in residential areas across the country including National Capital Region ;

(b) if so, the details thereof, State-wise; and

(c) the action taken by the Government against the persons operating industries in residential areas during the last ten years ?

(a)to (c) Under Section 17(m) of the Water ( Prevention and Control of Pollution ) Act, 1974 and Section 17 (h) of the Air ( Prevention and Control of Pollution ) Act 1981, the State Pollution Control Board ( SPCBs) / Pollution Control Committee ( PCCs) are mandated to advise the concerned State Government with respect to location of industries which are likely to pollute a stream or well or cause air pollution. The Central Pollution Control Board has also developed sitting guidelines for establishment of industries for 102 districts of the country. The establishment of industries in a city is governed by the Master Plan of that city.

In case of Delhi, `H` category of industries are not permitted in any of the areas including the industrial areas as per Master Plan of Delhi. The Master Plan does not permit establishment of industries in the residential areas.

Further, in compliance to Hon`ble Supreme Courts directives, large number of units falling under `H` category have been closed down and shifted from the given locations.
