(a) to (b): As per Seventh Schedule to the Constitution of India. ‘Police’ and ‘Public Order’ are the State subjects and as such the primary responsibility of prevention, detection, registration, investigation and prosecution of crimes, including crimes against women lies with the State Governments/Union Territory Administrations. Any decision of separation of investigation for case of sexual abuse from other crimes lies in the domain of the State Governments/ Union Territory Administrations.
