(c) As per entry 18 of Twelfth Schedule (Article 243 W) of the Constitution of India, regulation of slaughter houses and tanneries is vested within the powers and responsibilities of Municipalities of the States.
The Food Safety and Standards Authority of India (FSSAI) has prescribed detailed guidelines regard to slaughter houses under Regulation 2.1.2 (1) (5), Part IV of Schedule IV of Food Safety and Standards (Licensing and Registration) Regulations, 2011. The guidelines cover slaughter-houses and slaughtering of animals which includes specific hygienic and sanitary practices to be followed by Food Business Operators. In addition, State/UT Governments have also their own guidelines for slaughter-houses and slaughtering of animals.
The standards of meat and meat products including definition of ‘animal’ are prescribed under Reg. No. 2.5 of FSS (Food Product Standards and Food Additives) Regulations, 2011. As per regulation 2.5.1. The implementation and enforcement of Food Safety and Standards Act, 2006 and the rules and regulations framed thereunder primarily rests with the State/ UT Governments.
Regular surveillance, monitoring and inspection is undertaken by State/UT Governments under FSS Act, 2006 to check compliance of the provisions laid down under Food Safety and Standards Regulations, 2011 along with Schedule-IV of Food Safety and Standards (Licensing and Registration) Regulations, 2011. In case non-compliance to the provisions of the Act and the Rules and Regulations made thereunder, penal action is initiated under the provisions of the FSS Act, 2006
Many States has enacted Act preventing slaughtering of Cows. Further, export of meat sources from cows and their progenies are banned. The export of meat is permitted only from the Slaughter houses registered by the Agricultural and Processed Food Products Export Development Authority (APEDA). Further, the Health Certificates are issued by the Veterinarians after conducting Ante-mortem and Post-mortem examination.
The Animal Welfare Board of India issues advisories to the States with regard to the implementation of Slaughter House Rules. Also the Government of India has issued compendium compiling all the rules and regulation of slaughter houses in accordance with the direction of Hon’ble Supreme Court of India in its Order dated 17.02.2017 Writ Petition (Civil) No. 330 of 2001 in the matter of Common Cause Vs. Union of India and Others.
