Question : Pre-March 2018 Quota Framework

(a) the details of pre-March 2018 quota framework;
(b) the percentage of reservation for OBCs being implemented at the direct entry level
faculty position in Universities;
(c) whether it is true that the Law Ministry has recommended to strictly implement 27
per cent reservation for OBCs at all direct entry level faculty positions in Universities;
and
(d) if so, the manner in which the Government is planning to take this issue forward
since recruitment was stopped since March, 2018?

(a) & (b): 15% and 7.5% reservation was provided to the Scheduled Castes (SCs) and
Scheduled Tribes (STs) respectively in the direct recruitment of faculty and 27% to the
Other Backward Classes (OBCs) in direct entry level faculty positions in Universities.
The reservation rosters for the same were prepared by considering a University as a
‘Unit’, according to the provisions of the University Grants Commission (UGC)
Guidelines of 2006.
(c) & (d): The Hon’ble Allahabad High Court in its judgement to W. P. No. 43260 of
2016 dated 07.04.2017 directed that the reservation roster should be prepared by
considering the Department as a Unit instead of University as a ‘Unit’. The Central
Educational Institutions (Reservation in Teachers Cadre) Ordinance, 2019 was
promulgated on 07.03.2019, to restore the University as a Unit, which was
subsequently repealed and the Central Educational Institutions (Reservation in
Teachers’ Cadre) Act, 2019 was notified on 09.07.2019. Under the provisions of this
Act, 27% reservation is specified for SEBCs in direct recruitment of faculty.
Instructions have already been issued to all Universities vide UGC letter dated
04.06.2019 to actively fill all vacancies.
