Question : Communal Violence

(a) the details of incidents of riots/communal violence reported in the country during the last three years and the current year, State-wise;

(b) the number of persons killed/injured, gender-wise, guilty arrested/convicted and the action taken against them in each incident separately, during the said period, State-wise;

(c) whether criminal complaints have been filed against certain organizations for proactive and communal activities and if so, the details thereof;

(d) whether the Government has finalized a proposal to declare these organizations as ''unlawful'' under the Unlawful Activities (Prevention) Act and if so, the details thereof; and

(e) the other corrective steps taken by the Government to stop such riots/
communal violence in future along with the advisories issued to the States and police departments in this regard?

“Public Order” and “Police” are State subjects as per the provisions of the Constitution of India. The responsibilities of maintaining law and order, including investigation, registration/prosecution of crimes, conviction of accused etc. and maintaining relevant data rest primarily with the respective State Governments. The details regarding persons arrested/convicted, action taken against them etc. are not maintained centrally.
(c) & (d) The Students Islamic Movement of India (SIMI) has been found indulging in activities which are prejudicial to the security of the country and have the potential of disturbing peace and communal harmony and disrupting the secular fabric of the country. The Students Islamic Movement of India (SIMI) has been declared as Unlawful Association under Section 3(1) of the Unlawful Activities (Prevention) Act, 1967 on 01.02.2014 for a period of five years. The Unlawful Activities (Prevention) Tribunal confirmed the Government’s decision for declaring SIMI as an unlawful association on 30.07.2014.
During the last three years no proposal has been received from any of the State Government/UT Administration to declare any religious fundamentalist organization as Unlawful Association under section 3(1) of the Unlawful Activities (Prevention) Act, 1967.

(e) The Central Government assists the State Governments/Union Territory Administrations in maintaining communal harmony in a variety of ways like sharing of intelligence, sending alert messages, advisories etc. from time to time on important developments having bearing on communal harmony. The Central Government, on the requests of the States/Union Territories, sends Central Armed Police Forces, including the composite Rapid Action Force, created specially to deal with communal situations.
The Central Government has issued Communal Harmony guidelines to all States/ Union Territories, which inter alia, lay down standard operating procedures to be put in place to deal with situation arising out of the communal violence. These guidelines are aimed to maintain due vigilance, careful planning and preparatory measures which may prevent and pre-empt many possible incidents of communal violence.
