(a) whether there is interference by the Department of Forests in the implementation of Forest Right Act leading to breach of tribal rights;

(b) if so, the reaction of the Government thereto; and

(a) to (c) No, Sir. Ministry of Tribal Affairs (MoTA) is the nodal Ministry for implementation of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006. MoTA has issued Guidelines dated 12.07.2012 and notified the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Amendment Rules, 2012 to ensure effective implementation of the Act. Subsequently, Ministry of Environment, Forest and Climate Change has also issued an Advisory to the Forest Departments of all States/UTs on 15.01.2013 for appropriate action on the Guidelines and Amendment Rules to facilitate implementation of the Forest Rights Act.
