Question : RTE Act

(a) whether all the States/UTs have issued a notification with respect to admissions under Section
12(1)(c) of the Right of Children to Free and Compulsory Education (RTE) Act, 2009 and have a
record of the total number of seats available in private unaided schools under this provision and
if so, the details thereof for the last three years, State/UT and year-wise including Delhi;
(b) if not, the reasons therefor; and
(c) whether States/UTs maintain a record of children studying in private unaided schools under
the said Act along with the details of children who drop out of schools and if so, the details
thereof, State/UT-wise including Delhi for the above period and if not, the reasons therefor?

SINGH, TO BE ANSWERED ON 26.03.2018 REGARDING ‘RTE ACT’

(a) & (b): 29 States have issued notifications regarding admission for children from
economically weaker and disadvantaged sections as mandated by the Right of Children to Free
and Compulsory Education (RTE) Act, 2009. Goa, Manipur, Mizoram, Sikkim and Telangana
have not issued notifications in this regard. There are no private unaided schools in Lakshadweep
Islands whereas, RTE Act, 2009 is not applicable in respect of Jammu & Kashmir.
The total seats available in private unaided schools under Section 12(1)(c) of the RTE Act, 2009
is not maintained centrally. However, the detail of total number of children who were provided
admission is at Annexure.
(c): The number of children who take admission in private unaided schools under the Section
12(1)(c) of the RTE Act is maintained at State/UT level and is also available with Central
Government. However, record of children who drop out of schools after getting admission under
Section 12(1)(c) of the RTE Act, if any, is not maintained Centrally.
As Education is in Concurrent List, it is for the appropriate Government to issue notification for
admissions under Section 12(1)(c) and maintain records. The issue of non admission of children
under section 12 (1)(c) has been flagged with the States during annual meetings and at other
forums where they are urged to fulfil the gaps, if any, for implementation of the RTE Act..
