Question : GREEN COURTS FOR ENVIRONMENT CASES



(a) whether the Government has decided to set up special green courts at the State level to facilitate quick disposal of environment cases;

(b) if so, the details thereof; and

(c) if not, the reasons for delay to set up special courts at the State level?

(a) to (c) No, Sir. However, the Law Commission, in it’s 186th Report, has inter alia recommended establishment of separate ‘Environment Courts’ at the State level consisting of judicial and scientific experts in the field of environment, for dealing with environmental disputes besides having appellate jurisdiction in respect of appeals under the various Pollution Control Laws. The recommendations of the report are under consideration of the Government.
