Question : Fifth and Sixth Schedules

(a) the number of districts where the Fifth and Sixth Schedules of the Constitution have been implemented along with the details thereof, State/UT-wise;
(b) whether the said Schedules areproposed to be implemented in Dadra and Nagar Haveli; and
(c) if so, the time by which these Schedules are likely to be implemented?

Statement referred to in reply to Part (a) to (c) of Lok Sabha Starred Question No.*185 for answer on 2.12.2019 regarding “Fifth and Sixth Schedules”
(a) : Scheduled Areas are declared by President of India with the consultation of the Governor of the concerned states as per the provision of Section 6 of Part C of the Fifth Schedule under Article 244(1) of the Constitution of India. At present, Scheduled Areas have been declared in 97 districts (34 fully and 63 partly) inthe States of Andhra Pradesh, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand, Madhya Pradesh, Maharashtra, Odisha, Rajasthan and Telangana. The statement containing state-wise list of districts declared as Scheduled Areas is annexed at Annexure-I.

The Tribal Areas are declared as per provisions of Sixth Schedule under Article 244 (2) and 275 (1) of the Constitution of India as to the administration of Tribal Areas in the States of Assam, Meghalaya, Tripura and Mizoram. It also provisions for autonomous districts and autonomous regions in such areas. At present Tribal Areas under Sixth Schedule of the Constitution of India has been declared in ten districts of Assam, Meghalaya, Tripura and Mizoram states. The statement containing a list of districts declared as Tribal Areas under Sixth Schedule of the Constitution of India is annexed at Annexure-II.

(b) : The Ministry of Tribal Affairs has not received any proposal from Union Territory Administration of Dadra and Nagar Haveli for declaration of Scheduled Areas and Tribal Areas under Fifth and Sixth Schedule of the Constitution of India, respectively.
(c) : Does not arise in view of (b) above.
