Question : Allotment of Petrol Pump to SC-ST Community

(a) whether the Government has framed any guidelines for allotment of new petrol pumps/cooking gas agencies to the persons belonging to Scheduled Castes (SCs) and Scheduled Tribes (STs) and OBCs by Oil Marketing Companies (OMCs) and if so, the details thereof and the salient features of the same;

(b) the total number of existing petrol pumps/gas agencies allotted to the persons belonging to SCs/STs categories so far, OMCs/State/UT-wise along with efforts made by the Government/OMCs to fill up the quota to the said categories as per reservation policy and the time by which the said allotment is likely to be made;

(c) whether the cases of allotment of petrol pumps/gas agencies to SCs/STs community by OMCs are pending during the last three years and the current year ;

(d) if so, the details thereof and the number of petrol pumps/gas agencies owned by said categories of people cancelled so far along with the concrete steps taken /being taken by the Government in this regard; and

(e) Whether there is a marked disinclination amongst States to allot land for such petrol pumps to SCs/STs particularly in Uttar Pradesh, Bihar, Odisha and if so, the details thereof and the steps taken/being taken by the Government in this regard?

(a) : The guidelines for selection of Retail Outlet dealerships/LPG distributorships have a provision of 22.5% reservation for SCs/STs and 27% reservation for OBCs in allotment of retail outlet dealerships as a special dispensation. Within SC/ST, OBC & Open categories there is reservation for Defence personnel, Para Military Personnel/Central/State Govt. and Central/State PSU employees, Physically Handicapped Persons, Outstanding Sports Persons and Freedom Fighters as given below (except Arunachal Pradesh, Meghalaya, Nagaland and Mizoram) :

(b) to (e): State/UT-wise existing number of Retail Outlet Dealerships under SCs/STs categories as on 01-10-2016 are given in Annexure-I and that of LPG Distributorships under SCs/STs category as on 01-11-2016 is given in Annexure-II.

The State/UT-wise numbers of LOIs pending for commissioning of RO/LPG under SC/ST category as on 01-11-2016 are given in Annexure-III & Annexure-IV.

The efforts made by Government/OMCs to fill up the quota in allotment of petrol pumps/LPG agencies to the reserved categories as per reservation policy are as follows :

Retail Outlets –
Extension of time limit has been approved by MoPNG for a further period of 2 years i.e. upto 31-3-2018 or for a period of five years from date of issue of offer letter, whichever is later, to the pending LOI holders of SC/ST and other eligible candidates under corpus fund scheme to arrange land at a place of their choice anywhere in the country

irrespective of State/Class of market subject to the offered land meeting techno commercial viability norms has been granted by MoPNG. In addition there is a policy of divestment of temporary COCO for the certain categories of pending LOI holders including SCs/STs.

Also MoPNG had written to Chief Ministers of all States/UTs to make the suitable plots available especially for SCs/STs categories for fuel retailing so that they could be preferentially allotted to SCs/STs categories of allottees to meet the States/UTs objective of social upliftment.

LPG –

(i) One time option is given to all eligible persons to arrange land/godown at a place of their choice anywhere in the country irrespective of State/Class of market subject, to the offered site meeting techno commercial viability norms. The LOIs holder / empanelled candidate will take prior written consent of the OMC before incurring any expenditure on land / go down.
(ii) Where resitement of LOI is in another state the location will be adjusted in the roster of that state.
(iii) LOIs / empanelment of those candidates who fail to utilize this option within a period of one year will be cancelled.
(iv) Locations of existing LOIs / panel will be rostered afresh and advertised as per current selection guidelines.

OMCs work out the backlog for SC/ST category based on the outlets commissioned, COCO`s divested and LOI`s issued. The number of these locations are first advertised as a Backlog Roster as per new guidelines. The new 200 point roster is then prepared as envisaged in new dealer selection guidelines for RO dealerships / LPG distributorships under various categories (in all the States except Arunachal Pradesh, Meghalaya, Nagaland and Mizoram) for each state on industry basis so as to ensure the percentage reservation as envisaged by MoPNG for each category is achieved.
