Question : AMENDMENT IN COAL MINES NATIONALISATION ACT



(a) whether the Government propose to amend the Coal Mines Nationalisation Act with a view to curb illegal coal mining;

(b) if so, the details thereof;

(c) whether the officials of Central coalfields Ltd. have been involved in the illegal mining; and

(d) if so, the action the Government propose to take against the officials of the Central Coalfield Ltd. involved in illegal mining ?

(a)&(b) : No, Sir. Illegal mining is a term commonly used for mining without a valid prospecting licence or mining lease. The existing provisions of the Coal Mines (Nationalisation) Act, 1973, Mines and Minerals (Development & Regulation) Act, 1957 and various other Acts are sufficient to deal with the illegal mining. Section 30 of the Coal Mines (Nationalisation) Act, 1973 provides imprisonment upto 3 years for offences including illegal mining.

(c) : There is no report of involvement of CCL employees in illegal mining.

(d) : Does not arise in view of answer given in part (e) of this question .
