Question : Notifications Issued under Environment Protection Act

(a) whether notifications are issued by the Government under the Environment Protection Act regarding environmental clearance;
(b) if so, the number of such notifications issued by the Government during the last three years;
(c) whether the terms and conditions on the basis of which the said notifications were issued, have been/are being violated; and
(d) the number of complaints received by the Government in this regard during the last three years and the action taken by the Government thereon?

(a) and (b): Yes Madam. Under the Environment Protection Act, the Government has issued the Environment Impact Assessment (EIA) Notification 1994 vide S.O.60(E), dated 27.01.1994. Subsequently, EIA Notification 2006 was issued vide S.O. 1533, dated 14.09.2006 in supersession of EIA Notification 1994 amended from time to time. In the last three years, it has been amended 14 times.

(c) and (d):The terms and conditions of the said notifications have been violated. A total number of 224 complaints have been received in this Ministry in the last three years. The Government has issued S.O.804 (E) dated the 14th March, 2017 providing a six-month window for projects involving violation of EIA Notification to apply online for consideration of grant of Environment Clearance.
