Question : PHALGUNA SAKA MORE POWER TO CCI



(a) whether the Government has decided to give more powers to Competition Commission of India (CCI) and to extend its jurisdiction to cover all the Merger and Acquisition (M&A) deals without exception of any sector;

(b) if so, the details thereof;

(c) whether the Government proposes to give search and seizure powers to the CCI; and

(d) if so, the details thereof?

(a) & (b) The Competition Act, 2002 does not exempt any sector from the jurisdiction of Competition Commission of India in matters relating to Mergers and Acquisitions.

(c) & (d) Under Section 41(3) of the Competition Act 2002, Director General, Competition Commission of India (CCI), upon authorization by the Chief Metropolitan Magistrate, Delhi has the powers of search and seizure in any investigation. However, the Competition (Amendment) Bill, 2012 proposes to grant the Chairman, CCI the power to authorize the Director General, CCI for such search and seizure.

The Bill, which was introduced in the Winter Session of the Parliament, has been referred to the Hon’ble Parliamentary Standing Committee on Finance for examination.
