Question : DISPOSAL OF CIVIL CASES



(a) whether any provision has been made for disposal of civil cases within the period of one year with the implementation of Civil Procedure Code (Amendment) 2002;

(b) if so, the details thereof;

(c) the measures proposed to be taken by the Government to ensure that amendments made in Civil Procedure Code may not be against the principle of justice; and

(d) the measures proposed to be taken by the Government for making arrangements that poor people may also be benefitted by E-courts?

(a)&(b) No, Sir.

The Civil Procedure Code (Amendment) Act 2002, inter-alia, contains various provisions which fix time frame at various stages of a suit. These provisions will help in expeditious disposal of civil cases.

(c) The measures/provisions under the amended Civil Procedure Code are not against the principle of justice.

(d) E-courts use information technology in court management and adopt e-mail based processes & communications. These are comparatively less expensive & more transparent. They help the poor by reducing the cost of processes & communication and by expediting disposal of cases.
