(a) whether the Raghavan Committee has submitted its report;

(b) if so, the details of the recommendations made by the Committee; and

MINISTER OF STATE OF THE MINISTRY OF LAW, JUSTICE & COMPANY AFFAIRS

(a)Yes, Sir.

(b)The Committee has recommended that the Government should formulate a Competition Policy and implement the same through a new law (the Competition Act).

The Committee has recommended that liberalisation and economic reforms should continue; that State Monopolies and Public Sector Undertakings should be allowed only in very core areas and the rest should be privatised; that the Industries Development & Regulation Act (IDR Act), the Sick Industrial Companies Act

(SICA) and the Urban Land Ceiling Act should be reviewed for substantial modification/repeal; that the Small Scale Sector should be opened up for competition; that all barriers to free trade should go; that exit policies should be made liberal by suitably amending the Labour Laws; etc. etc.

The Committee has further recommended that the Competition Act should deal with all anti-competitive matters like abuse of dominance, mergers/ amalgamations that might lead to abuse of dominance and agreements between enterpriseds that could lead to or has led to anti-competitive behaviour. It has also recommended establishment of an independent Authority (to be known as the Competition Commission of India) to look into and adjudicate on such matters.It has recommended the repeal of the Monopolies and Restrictive Trade Practices Act, 1969 (MRTP Act) and winding up of MRTP Commission.

(c)The Government has circulated the Report widely among the general public, the State Governments/Union Territories and the Central Ministires/ Departments and has sought opinions and suggestions.The Government would take a final view on the matter on the basis of such feed-backs received from all concerned.
