Question : Average Speed of Trains

(a) whether the Railways has fixed minimum average speed for the corridors developed by the private developers and if so, the details thereof;

(b) whether the private developers have to maintain railway system to achieve the minimum average speed of the goods trains on quarterly basis;

(c) if so, whether there is any provision in the agreement to impose damages on the developers for not achieving the Key Performance Indicator and if so, the details thereof; and

(d) whether all the security related requirements of the Railways would be applicable to the developers in all the phases of construction, operation and maintenance and if so, the details thereof?

(a) to (c): As per the Model Concession Agreement of Non- Government Railway (NGR) and Joint Venture (JV) model, the developer/ concessionaire has to maintain the Rail System to achieve specified
average speed of freight train on a quarterly basis as a Key Performance Indicator. In case of noncompliance the developer/ concessionaire is required to pay damage at the rate of 1% (one percent) of the User Fees for the quarter for every 10% (ten percent) shortfall subject to a maximum of 5% of the total User fee for the quarter.

(d): The applicability of specific security related requirements of Indian Railways in all phases of construction, operation and maintenance during the concession period will depend on project to project. However, as per Model Concession Agreement of Non- Government Railway and Joint Venture model, the developer/concessionaire shall abide by and implement any instructions of Ministry of Railways for enhancing the security within and around the Rail System.
