Question : ACQUISITION OF LAND FROM FARMERS



(a) the direction given by the Delhi High Court in September, 2005 regarding acquisition of land of farmers for developmental purposes to the Government;

(b) whether the directions of the court are being fully complied with;

(a)to (d): The question does not contain specific details of the judgement of the High Court which is being referred to.

However, the High Court of Delhi in WP(C) No.10499-500/2004 vide judgement dated 5.9.2005 relating to acquisition of land did not find any infirmity in the acts of DDA. However, the High Court had noted that DDA has not been earmarking housing for weaker sections of the society. Master Plan of Delhi 2021 notified on 7.2.2007 provides that the developers of group housing shall ensure that minimum 15% of the FAR or 35% dwelling units, whoever units, whichever is more, are constructed for community service personnel Economical Weaker Section and lower income category. In another writ petition No.448/2005, the High Court vide its judgement dated 14.9.2005 issued certain directions to DDA. DDA has informed that order has been implemented and possession of plot handed over to the applicant on 10.11.2005 and lease deed has also been executed on 12.12.2005.
