Question : Social Security Code

(a)whether it is true that the Government is working on Social Security Code in India to provide all social security schemes under one umbrella and if so, the details thereof;
(b)whether it is true that the proposed code is very confusing and it will not abide by the concept of convergence of existing laws;
(c)if so, whether the Government is planning to connect the Social Security Code with the ground reality, if so, the details thereof and the time by which it will be published;
(d)whether the Government has undertaken any discussion with Trade Unions regarding Social Security Code and if so, the details thereof; and
(e)whether it is a fact that the Trade Unions have expressed their disagreement with the proposed code and if so, the details thereof?

(a) to (c): A draft Code on Social Security, 2019 has been prepared by amalgamating, simplifying and rationalizing the relevant provisions of the existing 8 Central Labour Acts relating to social security for organized and unorganized sector workers which aims towards expansion of coverage of social security. The said draft Code is, at present, under pre-legislative consultative stage.

(d) & (e): The formulation of Labour Codes involves consultation with stakeholders including Central Trade Unions, Employers’ Associations and State Governments in the form of tripartite consultation. One such tripartite consultation was held on 5th November, 2019 involving Central Trade Unions, Employers’ Associations and State Governments.
