Question : Medical Negligence

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) the number of cases of medical negligence reported in Central Government Hospitals across the country during the last three years, hospital-wise/State/ UT-wise;

(b) the number of complaints received by the Grievance Redressal Committees in the said hospitals during the said period, hospital-wise and the action taken thereon;

(c) the mechanism developed/being developed by the Government to monitor/ restrict medical negligence on part of the Doctor/Staff Nurses and other Para- Medical staff in the said hospitals;

(d) whether the Government has received complaints of irregularities in procurement of medical equipments/ medicines in the said hospitals during the said period, if so, the details thereof,
hospital-wise and the reasons therefor and if so, the details thereof; and

(e) the other steps taken by the Government to bring transparency in the functioning and procurement system of the said hospitals?

(a) to (e): In so far as three Central Government Hospitals in Delhi viz. Safdarjung Hospital, Dr. Ram Manohar Lohia Hospital and Lady Hardinge Medical College & Associated Hospitals are concerned, only one case of medical negligence has been established in respect of doctors of Safdarjung Hospital. The details of number of complaints received by these Hospitals during last three years are given below:

In order to regulate the conduct of doctors, the Medical Council of India (MCI), with the prior approval of the Central Government, has notified Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002 for the medical practitioners enrolled with Medical Council of India/State Medical Council to promote ethical medical practice. MCI or the appropriate State Medical Councils have been empowered to take disciplinary action against a doctor for violation of the provisions of the aforesaid Regulations in accordance with Chapter 8 of the said Regulations. Action for negligence against Nurses and other staff is taken by these Hospitals itself. Beside of these, Central Government Hospitals have robust Public Grievance Redressal Mechanism for reporting any grievance.


No case of irregularities in procurement of medical equipments/ medicines has been reported in respect of these Hospitals. Process of procurement in these hospitals is done in accordance with the relevant provisions of the General Financial Rules and other extant instructions issued by CVC, etc.
