Question : Manual of Parliamentary Procedure (MoP)

(a) whether Manual of Parliamentary Procedure (MoP), under Chapter 11, stipulates that rules will be framed within a period of six months from the date on which the relevant statute came into force;

(b) if so, the number of percent of rules/regulations/ bye-laws that were framed within the stipulated time by the concerned Ministries/Departments;

(c) the details thereof and the reasons therefor;

(d) the number of legislations that have adhered to the time limit in Lok Sabha and Rajya Sabha during the last five years;

(e) the steps taken by the Government to frame the rules of all legislations within the time frame;

(f) whether the rules pertaining to Citizenship Amendment Act, 2019 have been framed within the stipulated time and if so, the details thereof; and

(g) if not, whether extension has been granted for framing of such rules and the details thereof?

(a) Yes ;

(b) to (e) The information is being collected and will be laid on the Table of
the House.

(f) to (g) Ministry of Home Affairs has informed as under :-
“The Citizenship (Amendment) Act, 2019 (CAA) has been notified on 12.12.2019 and has come into force w.e.f. 10.01.2020. The Committees on Subordinate Legislation, Lok Sabha and Rajya Sabha have granted extension of time up to 09.07.2021 to frame the rules under the Citizenship (Amendment) Act, 2019. Further, the Committees on Subordinate Legislation, Lok Sabha and Rajya Sabha have been requested to grant extension of time up to 09.01.2022 to frame these rules.”
