Question : Bonus for Contract Workers

(a)whether there is any provision to pay bonus to the contract labourers employed in government, private and unorganized sector including construction sector;
(b)if so, the details thereof with the number of contract labourers paid bonus during each of the last three years and the current year, sector-wise, State/UT-wise;
(c)whether certain companies including in construction sector are reported by not paying bonus to their contract labourers; and
(d)if so, the number of such companies identified in this regard during the said period along with the action taken against them State/UT-wise and Sector-wise?

(a) to (d): The Central Government has enacted the Contract Labour (Regulation & Abolition) Act, 1970 to regulate the employment of contract labourers so as to place it at par with labourers employed directly in a establishment with regard to the working conditions and certain other benefits.
There is no provision to pay bonus to the contract labourers under the Contract Labour (Regulation & Abolition) Act, 1970. However, a provision exists under Rule 25(2)(v)(a) of the Contract Labour (Regulation & Abolition) Central Rules, 1971 which stipulates that where the workmen employed by the contractor perform the same or similar kind of work as the workmen directly employed by the principal employer of the establishments, the wage rates, holidays, hours of work and other conditions of service of the workmen of the contractor shall be the same as applicable to the workmen directly employed by the principal employer of the establishment on the same or similar kind of work.
