Question : Guidelines for Land Acquisition

(a) whether any guidelines/criterion have been laid down for acquiring land for the construction of fly overs on the National Highways, if so, the details thereof;

(b) whether various States including Uttar Pradesh and Uttarakhand have acquired land for National Highways, in compliance to his ministries guidelines/ criterion, if so, the details thereof;

(c) the details of land acquired for the above purpose in various States during Twelfth Five Year Plan and the amount paid as compensation package for it, State/UTwise; and

(d) the present status of National Highways in Uttar Pradesh and Uttarakhand?

(a) and (b) Land for the construction of National Highways (NHs) including flyovers thereon in the country is acquired under the provisions of the National Highways Act, 1956 in consonance with the applicable provisions contained in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

(c) The details of land acquired by the National Highways Authority of India (NHAI) in various States during the 12th Five Year Plan till the year 2015-16 are at Annexure-I. No state-wise data regarding payment of compensation paid for acquisition of land is maintained. However, total amount of compensation paid by the NHAI since the year 2012-13 is at Annexure-II. No separate data for acquisition of land for flyovers only and compensation paid for such land is maintained.

(d) At present total length of NH network in the State of Uttar Pradesh and Uttrakhand is 8487 kms and 2714 kms respectively.
