Question : VIOLATION OF ENVIRONMENTAL CLEARANCE NORMS



(a) the number of cases involving violation of the terms and conditions of environmental clearances by private developers and Government agencies in executing various projects that have come to the notice of the Government;

(b) the action taken against the violators; and

(c) the remedial steps taken by the Government to strictly regulate the terms and conditions of environmental clearances?

(a) The Regional offices of Ministry of Environment and Forests, based on the monitoring carried out by them during 2009-10 have reported 202 cases of non compliance of the stipulated environmental clearance conditions.

(b) The projects in respect of which significant non compliance was observed, were issued show cause notices and asked to give time bound action plan to install mitigative measures and to comply with the conditions stipulated in the environment clearance issued under EIA Notification 2006, whereas for minor violations they were asked to explain the reason of non compliance and ensure compliance.

(c) The Ministry has initiated several remedial measures to ensure strict compliance with terms and conditions of environmental clearance which inter alia include joint monitoring of such projects by the officers of the Regional office of Ministry of Environment and Forests and Central Pollution Control Board and putting the compliance status in the public domain.
