Question : Anti-Lock Braking System

(a) whether the Government has made speed governors and anti-lock braking system (ABS) mandatory for all commercial vehicles from April 2016;

(b) if so, the details thereof;

(c) whether the trucks and goods carrier owners have opposed this move of the Government citing practical difficulties; and

(d) if so, the practical difficulties given by the truck and lorry owners for opposing Government directives making speed governors and anti-lock braking system mandatory?

(a) to (d) Yes, Madam. Government has published G.S.R. Notification 389(E) dated 9th June, 2014 and G.S.R. 52(E) dated 23rd January, 2015, making it mandatory for new models of M3 and N3 categories manufactured on and after the 1st April, 2015 and existing models of M3 and N3 categories of vehicles manufactured on and after the 1st October, 2015, to be fitted with anti-lock braking system.

Government had issued G.S.R. Notification 290(E) dated 15th April, 2015 making it mandatory for all transport vehicles to be equipped with speed limiting device/speed governor by 1st October, 2015. Ministry had received a lot of representations from various stakeholders stating difficulties in equipping their vehicles by 1st October, 2015. After considering this, the government has issued a S.O. notification 1472(E) dated 22nd April, 2016 giving an extension for fitment of speed limiting device/speed governor upto 31st July, 2016.
