Question : FACING OUT OF DCA PENALTY



(a) whether attention of the Government has been drawn to the news-item captioned `100 foreign companies to face DCA penalty` appearing in Economic Times dated 15.4.2002 at page No. 6;

(b) if so, the details thereof;

(c) the time by when they have not filed their annual returns, balance sheet and other documents to the registrar of companies; and

(d) the reasons for the delay in taking action against these companies under Section 611 of the Companies Act 1956?

(a) to (d) : Some foreign companies applied for condonation of delay in filing of statutory documents [annual returns, balance sheets and other documents] with the Registrar of Companies. The delay varies from some days to a few years. Section 611 of Companies Act, 1956 does not apply to foreign companies.
