Question : VIOLATION OF MOTOR VEHICLES ACT .



(a) whether the Government are aware that jeeps, matadors, tractors with trolleys and sumo like vehicles ply on National Highway No.2 carrying passengers and freight in violation of the Motor Vehicles Act, 1988;

(b) if so, whether these vehicles have been responsible for accidents as reported in Hindustan Times dated November 12, 2000 captioned `Seven pilgrims killed in mishap`; and

(c) if so, the action taken by the Government in this regard?

(a) & (b) : As reported in the news item, the mishap occurred due to collision between the jeep carrying pilgrims and a bus. Under the Motor Vehicles Act, 1988, powers to issue permits to vehicles for carrying passengers and freight vest in the State Governments.
(c) : The Act itself prescribes various deterrent measures as well as penalties to deal with the offences committed in violation of the provisions of the Motor Vehicles Act. State Governments are competent to take necessary action in this regard.
