Question : Goods Carrying Fake ISI Marks

(a) whether goods carrying fake ISI mark are being freely marketed in various parts of the country;
(b) if so, the details thereof during the last three years, State-wise;
(c) whether raids and sample tests were conducted by the Bureau of Indian Standards (BIS) in this regard;
(d) if so, the details thereof during the said period, State-wise including Uttar Pradesh and Karnataka;
(e) the details of producers/traders that failed to clear the tests along with the number of cases registered and cancellation of registration; and
(f) the steps taken by the Government to ensure quality assurance in consumer products and services?

(a) to (e): From time to time BIS receives complaints on misuse of ISI mark. On receipt of such complaints, investigations followed by raids are carried out. Thereafter, prosecution is launched against the offender(s) in the Court of Law having jurisdiction over the matter. State wise number of search and seizure operations carried out during last three years is at Annexure-1.

The details of prosecution/complaints filed in the courts of Law year wise i.e. 2014-15, 2015-16, 2016-17 and 2017-18(up to November 2017) and the decisions in favour of BIS by the Courts for fake/improper use of ISI/BIS Standard Mark, are given in Annexure -II.

(f) : Central Government has implemented BIS Act, 2016 which provide for notification of conformity Assessment Schemes for any goods, articles, process, system or services with respect to any Indian standard or any other standard. It also provides for grant of certificate of conformity for any goods, articles, process, system or services against a standard or essential requirements and grant of licence to use standard mark with respect to Indian Standards.

Under various certification schemes run by BIS, surveillance, drawal and testing of sample to check its conformity, verification of facilities etc are undertaken regularly. Besides, BIS also organizes consumer awareness and Industry awareness programs regularly.
