Question : EXTRADITION OF HEADLEY



(a) whether any fresh initiative has been taken with the Government of the United States of America (USA) for the extradition of David Headley and his accomplices in the Mumbai attacks case;

(b) if so, the details thereof and the response of the Government of USA in this regard;

(c) whether any team has been sent/proposed to be sent to USA to interrogate the said accused;

(d) if so, the details thereof; and

(e) if not, the reasons therefor?

(a) to (e): A Statement is laid on the Table of the House.

STATEMENT REFERRED TO IN REPLY TO PART (a) TO (e) OF THE LOK SABHA STARRED QUESTION NO.358 BY SHRI BIBHU PRASAD TARAI; AND SHRI RAJAIAH SIRICILLA, MPs, FOR ANSWER ON 20-04-2010 REGARDING “EXTRADITION OF HEADLEY”.

(a) to (e): At different levels, Government of India have indicated to the U.S. Government that India would like David Coleman Headley to be extradited to India on charges linked to the 26/11 terrorist attack in Mumbai. Government of India have also sought direct access to question David Coleman Headley.

The modalities of grant of access to Indian investigators have to be confirmed by the US Authorities in the context of his plea bargain which, inter-alia, binds Headley to fully and truthfully testify in any foreign judicial proceedings held in the United States by way of deposition, video conferencing or Letters Rogatory, when directed by the United States Attorney’s Office.
