Question : PROCESS FOR RECOGNISING TRIBALS



(a) whether the Supreme Court has issued any order to know about the process for recognising the tribals;

(b) if so, the details thereof;

(c) the reaction of the Government in this regard;

(d) whether the Government proposes to exclude such tribes from Scheduled Tribes which are no more in the nature of Scheduled Tribes; and

(e) if not, the reasons therefor along with the reaction of the Government thereto?

(a): The order of Supreme Court has not been received in this Ministry.

(b)& (c): Does not arise in view of (a) above.

(d): The Government of India on 15-6-1999 (further amended on 25-6-2002), has laid down the modalities for determining the claims for inclusion in, exclusion from and other modifications in the orders specifying list of Scheduled Tribes. According to these modalities, only those proposals which have been recommended and justified by the concerned State Govemment /Union Territory Administration and concurred in by the Registrar General of India (RGI) and the National Commission for Scheduled Tribes (NCST) are to be considered for amendment of legislation.

Any legislation for exclusion from the Orders specifying lists for Scheduled Tribes, can be made after following the above procedure.
