Question : Amendment in Consumer Protection Act

(a) whether the Government is having any proposal to amend the existing Consumer Protection Act, 1986 since the existing provisions cannot tackle the misleading advertisements and consumer redressal mechanism;
(b) if so, the details thereof and if not, the reasons therefor; and
(c) whether the Government is considering to appoint Central Consumer Protection Authority with executive powers, if so, the details thereof?

(a) to (c) : The Consumer Protection Act, 2019 was notified on 9th August, 2019 to replace the existing Consumer Protection Act, 1986. The Consumer Protection Act, 2019 provides for establishment of an executive agency to be called the “Central Consumer Protection Authority” to regulate matters relating to violation of rights of consumers, unfair trade practices and false or misleading advertisements which are prejudicial to the interests of consumers and to promote, protect and enforce the rights of consumers as a class.
