Question : 277th Law Commission Report

a) whether all the State and UTs have responded to the recommendations of the 277th Law Commission Report as requested by the Government;
b) if so, the details thereof;
c) if not, whether the Government has sent subsequent reminders to the States, if so, the details thereof;
d) whether the recommendations of the Law Commission have been accepted by the Government, if so, the details thereof; and
e) if not, the reasons therefor?

(a) to (e): Ministry ofHome Affairs has informed that it had circulated the 277th report of the Law Commission to the States/ UTs for their comments on 16.10.2018, as the subject falls in the concurrent list. Till date 14 States have given their comments. The Department related Parliamentary Standing Committee on Home Affairs, in its 146th Report dated 23.06.2010, had recommended that there is a need for a comprehensive review of the Criminal Justice System of the country. Earlier, the Parliamentary Standing Committee in its 111th and 128th Report had also stressed upon the need to reform and rationalise the criminal law of the country by introducing a comprehensive legislation in Parliament rather than bring about piece meal amendments in respective Acts. The Government agrees with the recommendations of the Department related- Standing Committee on Home Affairs.
