Question : Irregularities in Medical Institution

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether the Medical Council of India has recently issued notice/circular cautioning students to check the status of medical colleges before seeking admission, if so, the details thereof;

(b) whether the cases of violation of rules/guidelines of Medical Council of India by various medical colleges have been reported to the Government, if so, the details thereof and corrective measures taken by the Government in this regard;

(c) whether private medical colleges are charging arbitrary capitation fees after implementation of NEET in the country, if so, the details thereof indicating complaints received during the last three years and action taken thereon along with corrective measures taken by the Government to check such practices;

(d) whether the Government proposes to unveil a rating system for medical institutions to help the students, if so, the details thereof and action taken in this direction; and

(e) the extent to which the said system is likely to be helpful for students?

(a): Since it had come to the notice of the Medical Council of India (MCI) that a few institutes are offering courses that have not been accorded permission by the Central Government as statutorily required under section 10 A of the Indian Medical Council Act, 1956, MCI issued a public notice on 28.09.2016 advising students/ parents/ general public to check the status of the medical Colleges before taking admission in any of the Medical Colleges/ Courses in Modern Medicine.

(b): Permission for starting of medical college/yearly renewal permission is given by the Central Government on the recommendation made by Medical Council of India (MCI) after assessment of infrastructure and other facilities. If any Medical College fails to meet the required standards, the MCI recommends to the Central Government not to issue letter of permission / renewal permission to such medical colleges for that academic year. Further, under the Establishment of Medical College Regulation, 1999, a medical college can be debarred for two years if found using fake/forged documents during inspections conducted by MCI.


(c): The fee structure of private medical colleges is decided by a Committee set up by the respective State Government under the chairmanship of a retired High Court judge in pursuance of the directions of the Hon’ble Supreme Court of India. It is for the Committee to decide whether the fee proposed by an institute is justified and the fee fixed by the Committee is binding on the Institute.

(d) & (e):: The Committee constituted under the Chairmanship of the Vice-Chairman, NITI Ayog to examine the legal provisions and modalities of working of the Medical Council of India suggested a draft National Medical Commission Bill which, among other things, provide for Medical Assessment and Rating Board (MARB) to determine the process of Assessment and Rating of Medical Educational Institutions as per laid dow
