Question : TRAFFIC OFFENCES



(a) whether there is a general complaint that notices for violation for compound offences under different sections of Motors Vehicles Act are being issued by the Dy. Commissioner (Traffic), Delhi Police in arbitrary manner without giving any opportunity to the commuters to justify their stand;

(b) if so, the facts thereof alongwith procedure followed in this regard;

(c) whether it is also a fact that fake challans are repeatedly being sent to those commuters who have once deposited their challans with the Traffic Police;

(d) if so, the number of such complaints received during the last three years; and

(e) the steps being taken by the Government to remove the shortcomings in the present system and make it more transparent and to stop the harassment of commuters at the hands of Police personnel?

(a) & (b): No, Sir. The notices for traffic violation are issued on receipt of information from the field staff, in prescribed proforma, indicating such details as the registration number of the vehicle, the nature of traffic violation, the date and place of occurrence of the incident, etc.

(c) & (d): No, Sir. However, during the period from 1st January, 2000 to 31st July, 2003, 16 such complaints were received, 14 of which were found to be unsubstantiated.

(e): The existing system is working satisfactorily as it ensures the least harassment to the commuters as it excludes any direct contact between the alleged offender and the traffic police personnel on duty.
