(a) to (c): No, Sir. There is no proposal to change the definition of illegal mining. Section 23C of Mines and Minerals (Development and Regulation) Act (MMDR Act) 1957, empowers the State Governments to frame rules to prevent illegal mining, transportation and storage of minerals and for the purposes connected therewith. Hence, control of illegal mining comes under the legislative and administrative purview of the State Governments.
However, as per quarterly returns on illegal mining (both for major and minor minerals) furnished by various State Governments to the Indian Bureau of Mines, a Sub-ordinate Office of Ministry of Mines, the State-wise details of cases of illegal mining reported during the last three years (upto Quarter ending September 2021) is given at Annexure-I. Further, as per the information provided by the State Government, the amount of fine recovered by the State Government of Rajasthan in respect of illegal mining during the period 2019-20 to 2021-22 (upto September, 2021) is as under:
