Question : Operable Mines

(a) the total number of operable mines in Jharkhand;
(b) the total number of lease applications received by different mineral rich State Governments since 2005 particularly in the State of Jharkhand;
(c) the details of those operable mines in the State of Jharkhand for which no application has been received along with the reasons therefor;
(d) the main reasons of turning down these applications; and
(e) the number of leases granted for mining since 2005 in different mineral rich States, State-wise?

Answer given by the minister

(a) : According to information received from State Government of Jharkhand, total number of Non-Coal operable Mines for Major Mineral in the State are 176.

(b) to (d): Under the provision of the Mines and Minerals (Development and Regulation) Act, 1957, State Governments are the competent authorities to grant mining leases. Applications for grant of mining leases are received by and processed by the State Governments in terms of this Act and the Rules made thereunder. Hence, information in respect to mining lease applications is not centrally maintained. As per the provisions that were in force prior to 12th January, 2015, the date of amendment of Mines and Minerals (Development and Regulation) Act, 1957 (MMDR Act), the State Governments were required to seek prior approval of the Central Government under Section 5(1) of the MMDR Act before grant of lease by the State Government only in respect of minerals listed in the First Schedule to the Act. Since 2005 till the amendment of the Act, 1374 applications were forwarded by the State Governments to the Central Government. Out of these, prior approval was granted in respect of 595 cases. The remaining applications were rejected due to non-compliance with the various provisions of the MMDR Act, 1957 and Rules framed thereunder. The State-wise details are at annexure-I.

(e) State Government of Jharkhand has reported that 36 mining leases have been granted by the State since 2005. The details of grant of mining leases by other mineral rich States as reported by them to Indian Bureau of Mines are at annexure-II.
