Question : TRIBUNALS FOR ELDERLY PARENTS AND SENIOR CITIZENS



(a) whether the Government is contemplating to create Tribunals for providing financial assistance to elderly parents and senior citizens who have been abandoned by their families;

(b) if so, legal binding of that on the offending children;

(c) whether all State Governments would be directed to create such tribunals; and

(d) if so, the powers of such tribunals and the enforcing authorities?

(a)to (d) The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 provides for setting up of Tribunals.If the children or relatives, as the case may be,neglect or refuse to maintain parents or senior citizen who are unable to maintain themselves,these Tribunals may order such children or relative to make payment of a monthly allowance to such parent or senior citizen. An order made under this Act will have the same force and effect as an order passed under Chapter IX of the Code of Criminal Procedure, 1973.

The Government have already circulated the Act to all the State Governments/Union Territory Administrations.
