Question : Renaming of High Courts



(a) whether the Government has approved the draft legislation for renaming some of the High Courts in the country;
(b) if so, the details thereof;
(c) the time by which the said legislation is likely to be enacted;
(d) the major terms and conditions thereof along with the consequential impact and legal constraints likely to follow after renaming of these High Courts; and
(e) whether the Government has received similar request from the Government of Odisha for renaming their High Court and if so, the details and the present status thereof?

(a) to (d): The High Courts (Alteration of Names) Bill, 2016 for changing the name of High Courts of Bombay, Calcutta and Madras as High Courts of Mumbai, Kolkata and Chennai respectively has been introduced in the Lok Sabha on 19.7.2016 to bring uniformity between the names of cities and names of High Courts. The Bill also has a provision which states that where immediately before the appointed day any legal proceedings are pending to which the High
Courts of Bombay, Calcutta and Madras are parties, the High Courts of Mumbai, Kolkata and Chennai shall respectively be deemed to have been substituted for the High Courts of Bombay, Calcutta and Madras in those proceedings.
