Question : REGULATION OF REALTY SECTOR



(a) whether some of the States have objected to the Government’s plan to regulate the realty sector;

(b) if so, the details of the States and the objections raised by them; and

(c) the action taken/being taken by the Government to resolve these objections?

(a) to (c): The Government has drafted the Real Estate (Regulation and Development) Bill, 2013 after consulting the various States and other stakeholders.

None of the States have per se objected to Government’s plan to regulate the realty sector.

Chhattisgarh has suggested that since ‘Land’ and ‘Colonisation’ are State subject, such legislation should be left to the States. The Ministry of Law and Justice has, however, opined that this Bill is within the legislative competence of the Parliament.
