Question : FIXATION OF TENURE OF SENIOR POLICE OFFICERS



(a) Whether the Supreme Court has directed to separate the functions of investigation, maintenance of Law and Order and fix tenure for senior Police Officers;

(b) If so, the details thereof; and

(c) The action taken by Delhi Police and other States to separate the functions of investigation and maintenance of Law and Order etc.?

(a) to (c): In Civil Writ Petition No. 310 of 1996 in the matter of Prakash Singh & others Vs. Union of India & others, the Supreme Court of India has on 22nd September 2006 issued directions to all States and Union Territories covering inter-alia : selection methodology and minimum tenure for Director General of Police and other key police functionaries and separation of investigation wing from law and order wing initially in towns/urban areas having population of ten lakhs or more State Governments/Union Territories have been advised to note the order of the Hon`ble Supreme Court for appropriate consideration and necessary action.
