Question : DEMOLITION OF ILLEGAL CONSTRUCTIONS



(a) whether unauthorized/illegal constructions are on the rise in the National Capital Territory (NCT) of Delhi;

(b) if so, the details thereof and the total number of such cases reported along with the action taken against the guilty persons in this regard during each of the last three years and the current year;

(c) whether the Government or any other agency has conducted any structural study about the existing buildings in the NCT of Delhi;

(d) if so, the details and the outcome thereof; and

(e) the steps taken by the Government to check such cases in future along with the corrective steps being taken to avoid demolitions of buildings and the advisories issued to New Delhi Municipal Council and Municipal Corporation of Delhi in this regard?

(a & (b): The details of unauthorized/illegal constructions reported in the NCT of Delhi during the last three years and the current year are as under:

(e): The Delhi Municipal Corporations(DMCs) have taken several measures to detect and control unauthorized/illegal constructions in their areas, which includes restructuring and strengthening of Central Control Room, Zonal Control Room and demolition squad etc. Besides this, a Nodal Steering Committee has been set up by the Hon’ble High Court of Delhi to monitor action against unauthorized/illegal constructions and encroachment on Government land in the NCT of Delhi. As and when any unauthorized/illegal constructions is noticed in their areas, action against the same is taken by the Building Department of the respective zone as per provisions of DMC Act, 1957.

New Delhi Municipal Council (NDMC) takes action against unauthorized/illegal constructions as per NDMC Act, 1994. Besides this, a dedicated cell called Enforcement Building Regulation Department is also working to check the unauthorized/illegal constructions.

The Delhi Cantonment has issued directives to its officials to monitor illegal constructions activity closely for taking stern action under the provision of Cantonment Act, 2006 and PPE Act, 1971 as applicable.
