Question : Arrest of IAS and IPS Officers

(a) whether some Indian Administrative Service (IAS) and Indian Police Service (IPS) officers have been arrested in the various States under different cases registered against them;

(b) if so, the details thereof during the last three years and the current year, State and year-wise; and

(c) the steps being taken by the Government in this regard?

Statement referred to in reply to parts (a) to (c) of the Lok Sabha Starred Question No.551 to be answered on 12.04.2017

(a) to (b): As per information received from the State Governments and the Ministry of Home Affairs, 19 Indian Administrative Service (IAS) officers and 5 Indian Police Service (IPS) Officers serving in various State cadres have been arrested since 2014 for offences under Prevention of Corruption Act 1988, other criminal provisions and on conviction by a court of law. Details of such IAS and IPS officers arrested during the last three years and in the current year (upto 31st March, 2017) have been indicated in Annexure-I.

(c): Rule 2(A) of All India Services (Discipline & Appeal) Rules, 1969 provides that a member of the service who is detained in official custody whether on a criminal charge or otherwise for a period longer than forty-eight hours, shall be deemed to have been suspended by the Government concerned. In order to provide safeguard to All India Service Officers against arbitrary suspension, All India Services (Discipline & Appeal) Rules, 1969 were amended vide Notification dated 21.12.2015. Subsequently, procedure to be followed for suspension of AIS officers posted in Ministries / Departments / State Governments were issued vide Office Memorandum dated 25.5.2016 which inter alia provides for (i) communication of information pertaining to suspension within 48 hours (ii) detailed report on suspension within 15 days and (iii) confirmation of suspension by the Central Government after 30 days.

With a view to complete disciplinary proceedings against members of AIS in a time bound manner, All India Services (Discipline & Appeal) Rules, 1969 have been amended recently vide Notification dated 20.01.2017 to provide specific timelines at different stages of the enquiry viz submission of representation by the charged officer on the chargesheet, completion of inquiry and submission of representation by the officer on advice of Union Public Service Commission. Subsequent to this amendment, guidelines regarding adherence to timelines for Departmental Proceedings have also been issued by the Government vide letter dated 15.3.2017.

Further, on conviction of a Member of Service by a Court of law on corruption charges, Special procedure under Rule 14 of All India Services (Discipline & Appeal) Rules, 1969 are initiated for imposing the penalty of removal / dismissal from service.
