Question : SIMI Activists

(a) whether the Government is aware that some members of the banned Student''s Islamic Movement of India (SIMI) have recently escaped from the high security Bhopal Central Jail and were later on killed in an encounter with police on the outskirts of Bhopal city;

(b) if so, the details thereof;

(c) whether the Union Government has sought a detailed report of the incident from the State Government of Madhya Pradesh;

(d) if so, the details thereof;

(e) whether any responsibility has been fixed on the escape of such SIMI activists from high security Bhopal Central Jail; and

(f) if so, the details thereof?

(a) to (f): Yes Madam. On learning about the incident of Jail break by the SIMI Activists, the Central Government, on 31-10-2016, sought a detailed report from the Government of Madhya Pradesh about the incident.

The Government of Madhya Pradesh furnished a detailed report vide their letter 12-11-2016 and informed that eight activists of the banned Organizations namely, Students Islamic Movement of India (SIMI) and Indian Mujahdeen(IM), who were allegedly involved in a number of criminal and terrorist incidents in different parts of the Country, were lodged in Bhopal Central Jail. They escaped from the Bhopal Central Jail on the intervening night of 30th - 31st October, 2016 after killing a Head Warder with sharp weapons, who was deployed for jail security.

In relation to the Jail break incident, a case crime number 270/2016 under sections 342, 307, 302, 120B, 224, 353 & 34 of the Indian Penal Code r/w sections 3, 10, 13, 16, 18 & 20 of the Unlawful Activities (Prevention) Act, 1967 has been registered at P. S. Gandhinagar, District Bhopal, Madhya Pradesh. The Madhya Pradesh Police had immediately carried out operation to nab these fugitives. Acharpura Village, PS Gunga, district Bhopal on 31-10-2016. A case
crime number 355/16 under sections 147, 148, 149, 307, 332 of the Indian Penal Code and sections 25, 27 of the Arms Act, 1959 has been registered at P.S Gunga District Bhopal, Madhya Pradesh relating to the incident of the encounter.

Madhya Pradesh Government has ordered a Judicial Enquiry into the incident under the Commission of Enquiry Act, 1952, to be carried out by a Retired High Court Judge, vide notification dated 7-11-2016. As per the Terms of Reference, the Commission will, inter-alia, look into the circumstances of Jail break and officers responsible for it, the circumstances in which the encounter took place, whether the action taken by the police in the encounter was justified under the prevailing circumstances and to suggest measures to prevent recurrence of Jail breaks.
