Question : Procedure for Stolen Vehicle

(a) whether a common man whose motorcycle is stolen has to go through a lengthy police and judicial process to get back his motorcycle once it is traced by the police and if so, the details thereof;

(b) whether a common man has to spend a lot of money and time on the said process; and

(c) if so, the steps proposed to be taken by the Government to make the aforesaid process short and simple for the common man?

(a) to (c) : Section 451 of the Criminal Procedure Code (CrPC) provides procedure for custody and disposal of property pending enquiry or trial. While ‘Police’ and ‘Public Order’ are State Subjects, ‘Criminal Laws and Criminal Procedure’ are in the Concurrent list under the Seventh Schedule to the Constitution of India, State Governments are responsible for implementation of Criminal laws and are also competent to make amendments in the CrPC, as per their needs.
