Question : Land to Private Hospitals

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether the Hon’ble High Court has directed private hospitals/nursing homes, which have been provided land on concessional rates, to provide free treatment of the poor people;

(b) if so, the details thereof along with directions issued by the Government in this regard;

(c) the details of such hospitals who have been provided land on concessional rates, State/UT-wise including Uttar Pradesh;

(d) whether any action has been taken against the erring hospitals, if so, the details thereof, State/UT-wise; and

(e) whether any committee of public representatives for monitoring the process for fulfilment of the conditions in this regard has been constituted, if so, the details thereof?

(a) to (e): Since Health is a State subject; no such information is maintained centrally.

However, in respect of National Capital Territory (NCT) of Delhi, it is informed that in pursuance of the order of Hon’ble High Court of Delhi dated 22.3.2007 in the matter of Social jurist V/s GNCTD & others in WPC No.2866/2002, certain private hospitals, which had got land at concessional rates from various land allotting agencies, are required to provide 10% IPD and 25% OPD free of cost to eligible category of Economically Weaker Section (EWS) patients. The details of availability of free beds for EWS category of patients are available on the website of Department of Health, Government of NCT of Delhi. A Monitoring Committee has been constituted by Government of NCT of Delhi to monitor the provisions for treatment in the identified private hospitals to economically weaker sections, which is as under:

(i) Director Health Services – Chairman.
(ii) Medical Officer In-charge Nursing Homes- Member.
(iii) Medical Superintendent of one of the concerned identified Private Hospitals – Member.
(iv) Medical Director St. Stephens Hospitals or his representative – Member.
(v) Shri Ashok Aggarwal, Advocate – Member.
